This Privacy Policy provides information on how the company BELLEMONDE DEVELOPMENT S.R.L. • collaborators/contractual partners, potential clients, clients, representatives, or other contact persons from the side of current or potential partners/clients who have entered into or intend to enter into any kind of contract, convention or agreement with the Operator, including reservation agreements, sale-purchase promises, or sale-purchase contracts for real estate (the „Contract”).

The Operator will process your personal data in accordance with this Policy and in compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (the "Regulation"), as well as applicable national and European legislation.

1. Personal data controller

The personal data controller is BELLEMONDE DEVELOPMENT S.R.L., a Romanian legal entity, with its registered office in Bucharest, District 1, 42-44 Bucuresti-Ploiesti road, Baneasa Business & Technology Park Complex, Building A, Section A2, 1st Floor, Room 1, registered with the Trade Registry under no. J40/21756/2022 and having sole identification code RO 47104105, email: contact@bellemonde.ro.

2. Types of personal data processed

In its activity as a real estate developer in Romania, the Operator may process the following personal data:

• identification data: name, surname, date and place of birth, series and number of the identity document, personal identification number (CNP) or other unique identification element, gender, citizenship and other details from the identity document/passport/residence permit, as well as copies of these documents, signature (handwritten or electronic), address (domicile, residence);
• contact details: phone number, email address, and mailing address;
• financial data (for example, but not limited to: bank account details, payment behavior data);
• tax data (for example, but not limited to: country of fiscal residence, tax identification number);
• professional data (for example, but not limited to: profession, occupation, position, name of employer or nature of own activity, specialization, information about the public function held, if you are a publicly exposed person (PEP), the quality, the holdings and, where applicable, the powers of representation held within legal entities);
• information about family situation (for example, but not limited to: marital status, matrimonial regime, kinship relations, marriage, cohabitation);
• information about economic and financial situation (for example: income data, source of income, data on owned assets, wealth source – if you are a PEP);
• image (contained in identity documents/captured by video surveillance cameras);
• criminal offences data (for example, data on international sanctions);
• where applicable, other data made available to the Operator during the Contract.

3. Purposes of processing

The purposes of processing personal data may include, depending on the situation:

• concluding and executing the Contract or taking pre-contractual measures, under Article 6(1), point b) of the Regulation;
• applying know-your-customer measures to prevent money laundering and terrorism financing, and reporting suspicious transactions, respectively, for the purpose of fulfilling a legal obligation (Law no. 129/2019 for preventing and combating money laundering and terrorism financing, as well as for amending and supplementing certain normative acts), under Article 6(1), point c) of the Regulation;
• providing information to various public institutions and authorities (for example, National Agency for Fiscal Administration, Competition Council, Data Protection Authority (ANSPDCP), National Office for Prevention and Combating Money Laundering) and retaining them as required by law, under Article 6(1), point c) of the Regulation;
• economic, financial, and accounting management (accounting preparation), organizing reporting, financial analysis, internal audit of the Operator, debt recovery, defense in court of the rights and interests of the Operator, resolving other legal issues arising from the Contract, under Article 6(1), point b), c), and f) of the Regulation;
• conducting marketing, advertising, and publicity activities, under Article 6(1), point a) of the Regulation. Regarding the marketing, advertising, and publicity purpose, only if the Client agrees for personal data to be processed for this purpose, the Operator may use personal data – for example, name, surname, email address, phone number, home address – in order to send newsletters, marketing messages, offers, news, future marketing campaigns, invitations to various events to promote real estate projects developed by BELLEMONDE DEVELOPMENT S.R.L. or by other affiliated companies or in the same group as BELLEMONDE DEVELOPMENT S.R.L., using the communication means provided by the Client (email, SMS, phone call, mail). The Client has the possibility to withdraw consent at any time and to unsubscribe from marketing communications at any time, using the unsubscribe option presented in the newsletter or by sending an email to dpo@bellemonde.ro;
• archiving in physical/electronic format of documents/information, including copies/backups, under Article 6(1), point c) of the Regulation;
• statistical purposes, under Article 6(1), point f) and Article 89 of the Regulation.

4. Legal bases of processing

The Operator processes your personal data based on the express provisions of the Regulation, as follows:

• Article 6(1), point b) – the processing is necessary for the performance of a contract to which the data subject is a party or to take steps at the request of the data subject prior to the conclusion of a contract;
• Article 6(1), point c) – the processing is necessary in order to fulfill a legal obligation incumbent on the Operator;
• Article 6(1), point a) – the data subject has given his consent for the processing of his personal data for one or more specific purposes;
• Article 6(1), point f) – the processing is necessary for the purpose of the legitimate interests pursued by the Operator or a third party.

Note: If you refuse to provide the requested data for the purposes related to the fulfillment of the legal obligations incumbent on the Operator or the conclusion or execution of the Contract, you will not be able to initiate legal relations with BELLEMONDE, as the latter will be unable to comply with the requirements of the regulations on customer knowledge, and other legal provisions, as well as to conclude, carry out and execute the Contract you requested.

5. Source of personal data

BELLEMONDE collects personal data from you (directly, through a legal or conventional representative or through another person or entity acting on your behalf) at the stage of initiating or during the business relationship or when you acces/visit/register for our online services or platforms (the website http://www.bellemonde.ro, social networks where BELLEMONDE is active – Facebook, Instagram, etc.), fill out the contact form available on the website, call the phone number displayed on the website, sign a Contract, contact us through one of our channels, or from other available sources (land registers, mass-media, public or private databases, institutions, authorities, National Trade Register Office, the portal of Romanian courts, based on recommendations, etc.).

6. Recipients of personal data

In order to facilitate the performance of the activities related to the purposes of the processing detailed above, the Operator may disclose these data to the following categories of recipients, depending on the situation:

• central and local institutions and authorities, such as: National Agency for Fiscal Administration, Competition Council, Data Protection Authority (ANSPDCP), National Office for Prevention and Combating Money Laundering, etc., in order to comply with the regulated obligations;
• courts, arbitration bodies, mediation, insolvency/bankruptcy professionals, bailiffs, debt recovery companies, for the purpose of formulating actions, recovering claims, representation in court;
• service providers and other contractual partners that support the Operator in carrying out the activity, such as: entrepreneurs, real estate agencies, accounting firms, audit firms, IT service providers, lawyers, public notaries, auditors, bailiffs, translators, real estate brokers, management companies, maintenance companies, post offices, couriers, safety and security companies, equipment suppliers (e.g. thermal power stations) in order to ensure the guarantee and the preparation of the commissioning documentation, the Owners’ Associations established within the real estate projects developed by the Operator, etc.;
• business partners, associates, investors, assignees (current or potential), banks and financing institutions, for the purpose of executing the Contract, including but not limited to obtaining financing and/or for ventures for the purpose of project development and/or for the conclusion of transactions in commercial assets (which may include a contribution, merger, acquisition, association or sale of assets);
• subsidiary companies, parent company, affiliates and other entities in the same group as the Operator, in order to carry out marketing communications/advertising messages, when the Client has expressed his consent for personal data to be processed for this purpose.

Disclosure of data to third parties is made according to the legal provisions for the categories of recipients specified above.

7. Retention period of the personal data

Your personal data are retained for a period of 5 years from the date of their collection by e-mail or through online platforms (website http://www.bellemonde.rosocial networks - Facebook, Instagram, etc.) or, in case of concluding the Contract, for the duration of the Contract, as well as for a period of 5 (five) years from the termination of the contractual relationship, except for the cases where the legislation in force imposes longer retention periods, in which case the latter legal periods apply. After the end of the retention period, the personal data will be destroyed or deleted from all media or anonymized.

The data collected through the video surveillance cameras are retained for 30 days, after which they are deleted. In specific, duly justified cases, only in compliance with the applicable legal provisions, the retention period of the relevant video recordings may be extended, if necessary, for a longer period, until the completion of the investigations of the incident due to which the extension of the retention period was necessary.

Personal data may be processed for marketing purposes from the date of obtaining the consent of the Client/Client representative and until the withdrawal of the consent of the Client/Client representative.

8. Individuals’ rights and how to exercise them

According to the Regulation, as a data subject, you have the following rights:

Right of information and access – You can request a confirmation of the processing of your personal data and how they are used, as well as access to that data.

Right to correct the personal data – If we process incomplete or inaccurate personal data, you can request their correction or completion at any time.

Right to erasure personal data – You may request the deletion of your personal data, amongst other reasons, if the purpose for which it was collected no longer exists, if its processing contravenes the legal provisions or if the processing is based on your consent, which you have revoked. You should note that there may be other reasons that prevent the immediate deletion of your data, for example, mandatory archiving periods, pending actions, claims, the exercise or defense of legal rights, etc.

Right to restriction of processing – You have the right to request a limitation on the processing of your personal data in the following cases:

• contest the accuracy of your data, this occurring over a period that allows us to verify the accuracy of your data;
• the processing of your personal data contravenes the legal provisions, but you oppose their deletion, requesting instead the restriction of the use of this data;
• we no longer need your personal data for the intended purpose, but you still need this data in order to establish, exercise or defend a right in court, or
• you have challenged the processing of your personal data, this occurring for the period of time in which it is verified whether our legitimate interests in the processing of personal data prevail over your rights.

Right to data portability – You can request to receive, under certain conditions, the personal data you have provided to us, in a format that can be read automatically or you can request that the data be transmitted to another operator.

Right to object – You may object to the processing of your data if the processing is carried out for the purposes of the legitimate interest of the Operator or for the performance of a task that serves a public interest, unless the Operator demonstrates that it has legitimate and compelling reasons justifying the processing and which prevails over your interests, rights and freedoms or as the purpose is to establish, exercise or defend a right in court.

The right not to be evaluated by automated profiling, including the creation of profiles – You have the right not to be subject to a decision based solely on automated processing, including profiling, whether it produces legal effects that concern you or affect you similarly, to a significant extent. In this regard, you have the opportunity to express your point of view, to request the intervention of a human operator, as well as the possibility to challenge such a decision, through the methods described in this Policy. 

Right to withdraw consent – You may withdraw your consent on using your personal data when such processing is based on consent. Withdrawal of consent does not affect the lawfulness of the processing based on the consent prior to its withdrawal.

The right to file a complaint with the competent supervisory authority – If you find that the processing of personal data violates the legal provisions in the field of data protection, you have the right to file a complaint with the National Supervisory Authority for Personal Data Processing based in 28-30 Bd. You may exercise your rights by a written signed and dated request, sent to the Operator's registered office, or by electronic means directly to the data protection officer of the Operator at the email address: dpo@bellemonde.ro. We assure you that we will make the necessary efforts to promptly respond to your requests and provide you with the details you require.

9. Data security

The site uses security techniques for information, such as firewalls, access control procedures and cryptographic mechanisms, all with the aim of preventing unauthorized access to data and to guarantee its confidentiality. We declare that we have adopted all necessary technical and organizational measures to guarantee the security and integrity of the personal data we process, as well as to avoid the loss, modification and / or access by unauthorized third parties.

10. This Policy may be updated from time to time

This Privacy Policy applies only to the website http://www.bellemonde.ro and its related subdomains, as well as to the pages presenting promotional campaigns, but not to pages controlled or operated by third parties. Please check the data protection statements of web pages controlled or operated by third parties, as these web pages are not under the control of BELLEMONDE and BELLEMONDE does not assume responsibility for their content and their data protection measures.

BELLEMONDE may update or change the Privacy Policy whenever it deems appropriate. Any change will be communicated to users by posting the updated version, at http://www.bellemonde.ro.
